What is an administrative litigation?

If a person who has filed a request for examination or adjudgment disagrees with the decision made thereon by the Commissioner of the Korea Customs Service or the Tax Tribunal, he or she may file an administrative litigation with an administrative court (the administrative division of a district court if located anywhere other than Seoul) within 90 days from the date of receipt of the written decision made thereon.

Suspension of the execution of an administrative disposition?

The execution of an administrative disposition will not be suspended even if an administrative litigation is filed against it.
However, if deemed necessary to prevent any possible irrecoverable loss from being caused by the execution of an administrative disposition, etc., it may be decided, ex officio or upon request by the party, to suspend the execution of such disposition.
Notwithstanding the foregoing, the execution of any administrative disposition is not allowed if it is feared that its execution will likely to have serious impact on the public welfare.
