Reporting Smugglings / Duty Evasions

Overview

The Korea Customs Service receives people’s reports about the evasion of any customs duties related to foreign trade transactions and any items being carried into Korea without going through normal export and import procedures.

Targets to be reported

  • Evasion of any tax amounts, such as customs duties related to illegal foreign exchange transactions such as moving some amount of money denominated in a foreign currency to a foreign country or foreign trade transactions such as importing or exporting and importing agricultural and marine products at low prices, etc.
  • Shipping foreign goods into or out of Korea, such as firearms, narcotics, counterfeit goods, jewelry, agricultural products through harbors or airports without going through normal export and import procedures
  • Any person who transports or stores these goods and any place used for storing them are also the targets to be reported.
  • The above-mentioned smuggling of goods, etc. requires confirmation of any law violation which belongs to the investigation and crackdown authority of customs officials. Please report any matter other than the matters mentioned below to an agency in charge of the relevant duties.
    • Any customs duty-related crime and/or any crime violating the Free Trade Act that occurs in the jurisdiction area of the relevant customs office
    • Any intellectual property infringement crime related to the customs clearance of exported or imported goods
    • Any crime illegally expatriating or bringing in means of payment or securities under the “Foreign Exchange Transactions Act”
    • Any crime violating the Foreign Exchange Control Act with respect to any export and import transactions and any service transactions directly thereto
    • Narcotic or psychotropic drug crimes or marijuana crimes which occur at airports / harbors which airplanes or ships traveling between Korea and foreign countries arrive at and depart from or in bonded areas in the jurisdiction area of the relevant customs office

Report processing procedures

Every reported matter about the evasion of customs duties is processed by the Examination Department of the KCS Headquarters, and other reported matters are handled by the investigation department of each relevant customs office. Once any relationship with export and/or import has been confirmed and the personal information of the reported person and the facts of suspicion about him/her have been found to be specific with documentary evidence on the basis of the contents of the reported matter, it is immediately accepted and processed as a criminal case. However, if the facts of suspicion are unclear, if the reported person is not specific, the reported matter is unreliable, or any relationship with export or import cannot be confirmed, a decision will be made on whether to process it or not as a criminal case after having supplementary data submitted. In the event of any false or slanderous report, the reporting person is liable to be responsible for the reported contents.

Selection of reward payment criteria for reports

The reward payment criteria for smuggling reports are classified into the criteria based on the amount of the case and the criteria based on the actual national revenue depending on the time of reward payment, so if a reporter selects the reward payment criteria he or she wants, the relevant customs office will decide on the reward payment criteria in accordance with the reporter’s selection.
When the criminal has fulfilled the notified main requirements, if a lawsuit has been filed against the case or if it has been sent to the prosecutor’s office, the reward payment is based on the amount of the case. When it has been confirmed that the fine and/or the amount to be additionally collected have been paid to the national revenue, the reward payment is based on the actual national revenue. However, the evasion of any customs duty has been reported, the reward for the report is paid based on the actual national revenue.
The receiver of any smuggling report in each customs office informs the reporter that he or she may select the reward payment criteria he or she wants, so if there is anything you want to know about the selection of the reward payment criteria you want, please contact the smuggling report receiver.

Reward payment times

If the contents, etc. of the report are recognized to have contributed to the arrest, etc. of the customs duty-related criminal(s), a reward of up to 50 million (100 million won in the case of narcotics) won may be paid to the reporter.
The reward is paid differentially depending on the value of the contents of the report and the degree of contribution to the arrest of the criminal through the deliberation of the Reward Screening Committee.
The reward payment times are as follows:

  • When the criminal has fulfilled the notified main requirements
  • When a lawsuit has been filed against the case or when it has been sent to the prosecutor’s office
  • When it has been confirmed that the fine and/or the amount to be additionally collected have been paid to the national revenue
  • When it has been confirmed in the case of harmful goods that they have been uncovered
  • No reward will not be paid to the reporter in any of the following cases as a result of the investigation of the smuggling report:
    • Where there is no fact of suspicion found as a result of the investigation
    • Where the crime has been found to be different from the contents of the smuggling report
    • Where the contents of the report are so vague that the actor, the target and the method are unknown
    • Where the reported matter is a matter being already under investigation or screening
    • Where the reporter does not give his contact, telephone number, etc.
    • Where the amount to be additionally collected due to the evasion of customs duties, etc. is below one million won

※ If the reported case has been doubly reported to any other agency as well, the reward will not paid to the reporter repeatedly.

Reward payment criteria

If a report has contributed to the uncovering of smuggled goods or the smuggler(s), or if it has helped the amount of the evaded customs duties to be additionally collected, a reward of up to 50 million won (100 million won in the case of narcotics) may be paid to the reporter.

Guarantee of the reporter’s privacy

In case of any smuggling report, the reporter’s privacy is thoroughly guaranteed. In addition, the guarantee of the reporter’s privacy is strictly prescribed by law, so feel free to report any smuggling event to the relevant customs office.
